Right to Blood or Urine Test

You are NOT entitled to a blood or urine test in an alcohol-related DWI. However, if you submit to breath testing, then you can have a copy of the test results and have the right to have an additional breath, blood or urine test taken by a medical professional of your choice and at your expense. Certainly, if the results of such additional testing contradicts the breath testing results, our defense team can use that evidence to challenge the reliability of your breath test results.
