South Jersey DWI 10-Year Step-Down Rule

In most cases, a DWI that is more than 10 years old cannot be used against you for sentencing purposes, and, as such, is not considered by the judge. Therefore, under the 10-year step-down rule, a second offender could possibly be treated as a first offender and a third offender could possibly qualify for sentencing as a second offender. A fourth or greater conviction will always be treated for sentencing purposes as a third offense.
